Who Needs Estate Planning?

When clients contact me, I take the time to learn about their goals and what they hope to accomplish with their estate planning. I help clients prepare wills, trusts, powers of attorney and health care directives to meet their needs.

All adults need estate planning, and I represent a variety of individuals, including:

  • Widows and widowers: If you and your spouse have everything in a joint tenancy, it is important to have your estate planning documents reviewed when the first spouse dies. Many couples think that they don’t need estate planning, because all of their assets are held in joint tenancy, and their assets will go to the surviving spouse. But what happens when the surviving spouse dies? If you don’t have some estate planning in place, your estate will have to be probated.
  • People going through life changes or changes in the family: If you are starting a second marriage, are recently divorced, or if there were other changes in your family, reviewing your estate planning documents can help to prevent the wrong person from receiving any unintended benefits.
  • Older individuals getting married or remarried: If you lived a full life before getting married, a trust allows you to control how your money or property is distributed. Many of my older clients who are in a second marriage are concerned about providing for their separate families, while still not neglecting their new spouse.
  • Parents with a “problem child:” Very often an adult child may have substance abuse problems, a gambling addiction, or similar issues. I help clients structure trusts that will preserve money for such children, while providing them with an income after the parents are gone.
  • Young couples with children: If you are young parents, it is important to have the legal work in place so your children are taken care of if anything happens to you. As your assets and children’s needs change, I can help you amend your documents to reflect your current lifestyle.
  • Single people: If you do not have things written down, the court will give your assets to people in a particular order. Good estate planning allows you to dictate who receives your things after you pass.
